After a four month engagement in 2008 between IOR’s and PECG ending with AB 2966 being reduced to a study bill, no one expected another legislative attempt aimed at IOR’s again this soon. Well it happened again. This soon.  

In February, Assembly Member Caballero introduced AB 405 to allow public health care districts to use a design-build for the design and construction of hospital facilities. 

The issue of owners using the design-build project delivery system normally is not a subject that concerns IOR’s however it is the content of a bill that does. Recently PECG proposed amendments that slightly resembled verbiage contained in AB 2966 (2008).
The proposed amendment would require “the office” to be the responsible agency for the performance of construction inspection services and that “the department” may use department employees or consultants to perform the services.  Sound familiar? 

Thanks to the sharp eye of the coalition that preserved the integrity of both the Field Act and the Alquist Act last year, AB 405 was pulled from the file by the author and made a two year bill prior to the Assembly Appropriations Committee hearing this morning.
